Abstract

The advancement of Assisted Reproductive Technology (ART) in the health sector has provided an opportunity for every individual to conceive a child. This innovation also opens up a more incredible opportunity towards surrogacy for surrogate mothers. Couples who are unable to conceive will have a chance by choosing surrogacy as an option regardless of the consequences. There is no specific legislation related to surrogacy in Malaysia, which has led to the rise of various medical and social work interventions. The purpose of this paper is to highlight issues and dilemmas that arise from surrogacy throughout the surrogate mother case study in a tertiary referral hospital. The results showed that surrogacy raised issues and dilemmas in terms of the identity of the baby born to a surrogate mother, biological parental rights and infant care, psychosocial and economic; the roles of social workers, religious, national legislation, and agencies involved in case handling. In conclusion, there are conflicts on the opinions of family concept, the vulnerability of the surrogate mother's social welfare, legal uncertainty, and absence of clear guidelines in handling surrogate mother cases.
